Terms of Service

1. Overview

These Terms of Service ("Terms") govern your use of the Quantum Secure Gateway API service ("QSG" or the "Service") operated by Peter Matejka ("I" or "me"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

The Service is provided at api.quantumsecuregateway.com and associated web properties at quantumsecuregateway.com and quamtx.com.

2. Eligibility and account registration

Access to the Service requires a valid API key provisioned through the access-request process. You must provide accurate and complete information when requesting access and keep your account details current. You are responsible for all activity that occurs under your API key and for keeping your key credentials confidential.

The Service is intended for lawful use by businesses and organisations. It is not available to individuals acting in a personal capacity, or to any entity or individual prohibited from receiving the Service under applicable law.

3. The service

QSG provides governed, hardware-derived entropy via a REST API. Entropy is sourced from IBM Quantum hardware and processed through conditioning (SHA-256-CTR) before delivery. Each entropy draw is accompanied by a signed provenance record and audit trail.

The Service operates under a explicit fallback model: when the hardware entropy reservoir is unavailable, exhausted, or fails NIST SP 800-90B health checks (RCT/APT), the Service falls back to a CSPRNG source. Fallback events are always signalled explicitly in the API response and never occur silently.

I target 99.9% monthly availability for Enterprise tier customers. Availability targets by tier are as specified in your service agreement. No SLA is a guarantee of uninterrupted service; see Section 7 (Limitation of Liability) and your specific service tier terms.

4. Acceptable use

You may not use the Service:

• To generate cryptographic keys or entropy for use in any unlawful, harmful, or malicious activity
• To conduct any activity that infringes on or violates the intellectual property rights of Peter Matejka or any third party
• To attempt to gain unauthorised access to any system, network, or data
• To interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure
• To reverse-engineer, decompile, or disassemble any component of the Service
• To use the Service in any manner that would subject it to obligations under any export control or sanctions regulations

You are responsible for ensuring that your use of entropy delivered by QSG complies with all applicable laws and regulations in your jurisdiction, including but not limited to cryptographic import/export restrictions and financial-sector key-management requirements.

5. Service tiers and billing

The Service is offered in tiers as described at quamtx.com/tiers/. Each tier defines specific entitlements (daily request limits, rate limits, retention periods, support levels). Usage beyond a tier's entitlements will result in request rejection with an appropriate error code until the next billing cycle or a tier upgrade.

Entitlement overages are billed at the rates disclosed at access provisioning. All fees are exclusive of applicable taxes unless stated otherwise. Billing disputes must be submitted in writing within 30 days of the invoice date.

6. Intellectual property

Peter Matejka retains all intellectual property rights in and to the Service, including the API design, documentation, provenance schemas, and any proprietary entropy conditioning or quality-assurance methodology. These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms and your tier agreement.

You retain all rights to the data and content you submit through the Service. You grant Peter Matejka a limited licence to process your data solely as necessary to provide the Service, including generating and storing the audit trail.

7. No warranty; limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

I DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM ALL SECURITY THREATS. ENTROPY DELIVERED BY THE SERVICE IS SUBJECT TO THE HARDWARE CHARACTERISTICS OF THE UNDERLYING QUANTUM COMPUTING INFRASTRUCTURE; I MAKE NO GUARANTEE REGARDING THE MINIMAL ENTROPY RATE BEYOND THE STATED ADMISSION THRESHOLD OF entropy_score ≥ 0.99.

IN NO EVENT SHALL I BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR COST OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF I HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

MY TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO ME IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

These limitations apply to the fullest extent permitted by applicable law. Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for consequential damages, so the above exclusions may not apply to you.

8. Data and audit records

Audit records (provenance data, entropy hashes, health-check results, metadata) are retained as described in the Privacy Policy and your service tier agreement. You are responsible for exporting and retaining copies of audit records for your own compliance purposes. Peter Matejka is not a records custodian for your regulatory obligations.

Entropy values are not retained after delivery to the client. Peter Matejka is not a key-generation service and does not generate, store, or transmit cryptographic keys on behalf of clients.

9. Termination

You may terminate your account at any time by submitting a deletion request to support@quamtx.com. Upon verification, your account data will be deleted within 30 days. Audit records are retained per the retention schedule in your service tier agreement, which survives account deletion.

I may suspend or terminate your access immediately, without prior notice, if I reasonably believe you have breached these Terms or that continued access poses a security risk to the Service or its users.

10. Modifications to the service

I may modify, update, or discontinue any feature of the Service at any time. For material changes that adversely affect the functionality relied upon by a production system, I will provide 30 days' notice via the contact email associated with your account and/or a notice posted on the service status page at quamtx.com/status/.

API version /v1/ is the current stable version. We maintain a deprecation policy and will provide a minimum 6-month deprecation window before any version is retired, with free migration support to the current version.

11. Governing law and jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.
